Gray Divorce in Ohio Rates Among Baby Boomers

In my practice as an Ohio divorce attorney, I continue to see more and more older couples pursuing what is often called a gray divorce in Ohio.. It seems like this is a good time to post an update on this topic. My last article was on May 4, 2024, which also included links to 5 previous posts of ours on this trend.

A “gray divorce” is a divorce after the age of 50. In Ohio, divorce among those 65 and older has skyrocketed within the past few decades. According to a 2024 report conducted by the National Center for Family & Marriage Research at Bowling Green State University (BGSU), the share of divorce rates among adults age 65 and older has nearly tripled since 1990. Interestingly, the research also demonstrates that divorce rates among those aged 50 to 64 slightly declined in 2022, indicating that gray divorce is more common among the baby boomer generation, or those born between the years 1946 and 1964.… View Full Article → “A Baby Boomer Phenomenon? How the 3 C’s of Divorce Can Help You Uncouple Peacefully

It is no secret that divorce tends to be a highly stressful process. Following the 3 C’s of Divorce can make the process less stressful, less costly, and may even speed up the process.

1. Communication: A Core Principle of the 3 C’s of Divorce

Communication skills often impact one’s ability to negotiate. In her article, Rebecca Todd shares that “understanding how we communicate and what impact that can have on how we negotiate can help us to be better negotiators with better outcomes”. Negotiation is a critical skill in any collaborative divorce settlement, since an agreement will need to be filed with the court when the divorce is finalized.

Poor communication also tends to lead to conflict and confusion. When parties are straightforward it is easier to understand each other’s goals and priorities. It is important to note that a divorce with more conflict tends to be more expensive and lengthy than a divorce where parties communicate well with one another and their attorney.… View Full Article → “The 3 C’s of Divorce: What They Are and How They Can Help You Uncouple Peacefully!”

Why January Is Divorce Season

Financial Reasons Behind Why January Is Divorce Season

January has long puzzled family-law attorneys, who often refer to the month as “Divorce Season.” Understanding why January is divorce season can help couples prepare emotionally and financially.

Can A Child in Ohio Pick Which Parent to Live With in a Divorce – Yes or No?

Child election law Ohio

ANSWER: The answer is NO – they cannot choose under current Ohio child custody preference laws.

Publisher’s Note: There is so much misinformation online these days that perhaps that is one of the reasons clients frequently still ask me this question. The Ohio age of election law was changed nearly 30 years ago! Here is the history about this change for those wanting to know the correct posture of that law.

The History of the Ohio Child Election Law

Prior to 1946, Ohio General Code §8033 made it mandatory that a child ten years of age or older “must” be allowed to choose which parent they preferred to live with, and the court would have to follow that choice unless the court deemed that parent “unfit.” Venable v. Venable, 445 N.E.2d 1125, 1130 (Ohio Ct. App. July 9, 1981). Even as recently as 1989, the Ohio Revised Code §3109 stated that children twelve years of age or older could choose which parent to live with.… View Full Article → “Can A Child in Ohio Pick Which Parent to Live With in a Divorce – Yes or No?”

What is the CARES Act? How the CARES Act and Divorce Intersect Financially

The CARES Act and divorce may not seem directly connected, but the law’s financial relief provisions can significantly affect how couples divide assets and plan post-divorce finances. The Coronavirus Aid, Relief, and Economic Security (CARES) Act is an economic stimulus bill. Its purpose was to provide financial assistance to individuals and families, healthcare systems, and small businesses and industries. On March 20, 2020, the President signed this bill into law which provided up to 2 trillion dollars in much needed relief and financial assistance to individuals and businesses suffering the social and economic impact of the COVID-19 pandemic.

Tax Implications of the CARES Act During Divorce
