What Is the Average Cost of a Contested Divorce in 2025?
Attorney fees for a contested divorce case can be staggering! The average cost of a contested divorce in 2025 continues to rise, with many lawyers charging between $250–$400 per hour. Most lawyers will only accept representation on a divorce matter based on an hourly rate subject to the number of hours involved. According to an article by Wyzer Staffing, the 2025 hourly rate range for family lawyers is between $250 to $400 per hour.
A recent Clio Legal Trend Report states that the average attorney hourly rate is $313 per hour. In a Martindale-Nolo survey, 20% of divorce clients report paying their divorce lawyer over $400 per hour. I can tell you that I see divorce lawyers charging over $400 per hour in Dayton, Ohio, which is not an expensive part of the Country to live in.

How Lawyer Fees Drive Up the Average Cost of Contested Divorce
Much of the information and statistics that I could find on the internet showing these likely costs are very outdated. I did find an interesting breakdown below from 2019.
Using AI to help me calculate a cumulative inflation adjustment to those 2019 figures, it says it would result in a 28.36% likely increase. So, the updated cost for a divorce that goes to trial on two or more issues would rise from $23,300 to $29,908 in 2025.
According to Divorce.com, typical hourly rates for divorce lawyers range from $260 to $450+ an hour, with upfront retainer deposits ranging from $3,000 to $7,500. They also concluded that an average contested divorce would cost between $11,000 to $25,000. Honestly, I have seen attorney fees in many hotly contested cases end up costing well over $50,000!
These are only the financial costs without even considering the emotional costs and negative impact and stress that a divorce can create. Does that sizable financial commitment make sense to you?
